Della Corte v. Ramirez, 81 Mass.App.Ct. 906 (2012)
In a Rescript Opinion, dated February 2, 2012, the Appeals Court affirmed the Suffolk Division of the Probate and Family Court’s denial of Gabriella Della Corte’s (“Gabriella”) request for modification of the award of joint legal custody to her former spouse, Angelica Ramirez (“Angelica”). On appeal from the Judgment of Modification, Gabriella raised three issues: 1) that Angelica was not the child’s legal parent; 2) that the Judge erred in finding no material or substantial change in circumstances warranting a change in the joint legal custody of the child; and 3) that it was error to not set out whether continued joint custody was in the child’s best interests.
